Do babies born of Illegal Aliens in the US deserve American citizenship?

I read somewhere that The 14th Amendment states: "all persons born or naturalized in the United States are citizens"

Is that right?

I think it is. A very frequent occurance in southern California is for a pregnant Mexican woman to get a day pass into San Diego, then give birth there. Since the child is now a US citizen, the mother gets an instant means of getting a 'green card' and eventual US citizenship.

My wife is a British subject. She is now working on getting her US citizenship. Despite being married to a US citizen for 20 years, and having six children who are all US citizens, it looks like it will take about 1 1/2 years for her to become a citizen.

Two of my children were born in Germany. However, as I was serving in the US military, although they were born in a German Frauenklinik rather than a US hospital, they both have certificates of birth abroad, which makes them US citizens by birth. They also have german birth certificates, so they could be German citizens if they wanted to.

That is not true, at least not now. Our son is a US citizen, neither of us have any instant means of getting a green card. Years ago this may have been true but certainly not in the last three. As for your question Xtra... we have living proff of it, but we were not illegals at the time.

What will it take for you to get permanent residency? With your son a citizen, I would think that you should have some preferential treatment towards getting that status, don't you?

We are trying to get a way for my wife's brother and sister, and their families, into the US, but as a resident alien, she can only sponser her parents or children. As a citizen, she will be able to sponsor siblings and others.

The last time we asked an immigration lawyer (years ago) he said that when our son reaches the age of 21 then he can sponsor us, but keep in mind that the immigration laws of the US are some of the fastest changing laws in the world, they change slightly each year and so by the time my son is 21 it can be something different. As far as I know, the real only legit way to enter the US with the purpose of working is to be educated sufficiently that a company or organization is willing to hire you (which includes sponsorship). Basically those in the teaching or medical professions get through quite easily using this method.

Yes, but do you know it will take forever! I know that if she wants to sponsor a sister or brother it will take at least 7-8 years!!!!!!

Yes, they do. It is not the baby's fault that the parents are illegal persons living in the US (I just hate the word 'alien' make you feel like if you are from Mars --> ). It is sad to know though that the baby even though is a US citizen may have to live in another country if Immigration catch their parents.
