I might be wrong but I think you have to be an actual citizen of the country under the visa waiver program in order to qualify. I know this because we had an exchange student from the UK who wanted to return for vacation and she didn't need a visa to enter because she's a citizen of the UK.

What ever country your passport is from has to be in the waiver program. It doesnt matter if you are a permanent Japanese resident. Things like your Japanese Drivers License may convert in some countries (not the US).

It seems that the Obama Administration is seeing the 'benefit' of having illegals stay in the US. This further will give claim to those who enter the country to try and 'pass' while those who want to do so legally get it tougher:

Morally maybe its the wrong reason, civilly its the right thing to do. If more of us did that how many illegals will there be. As we're on the topic, the Obama administration isn't easing up any or at least some states aren't. Now they are raiding farmer's markets, Source 9

Comments: Do certain states in the US process immigration applications faster than others? I heard that some states take really long and others can do it faster when they are not main stream states like Florida, New York or California.
