A family in Oklahoma is in disbelief after a judge handed custody of a young child to her father, who is a convicted sex offender.
Six years ago, Nicholas Elizondo was convicted for raping his stepdaughter, who was 6-years-old at the time.
Elizondo pleaded guilty and took a plea deal. He was sentenced and served six years in prison. Recently, Elizondo filed a petition in court for custody of his daughter named Sarah, who is the same age as his victim at the time of the alleged rape.
The girl's mother Lisa Knight and Elizondo are divorced. While Elizondo was initially given supervised visitation, he was later awarded unsupervised visits with his daughter.
Now, he fought for custody after claiming that he was denied his right to see Sarah. Oklahoma County Judge Howard Haralson awarded sole custody to the father.
Elizondo is a registered sex offender and was convicted. He was imprisoned in 1995 after committing lewd acts with a child under 14-years-old. He was paroled and completed probation.
Knight said that her former husband did not fight for custody until their daughter was the same age as the victim, who he allegedly sexually assaulted. Knight also claimed that Sarah said she had been touched inappropriately by her stepbrother while visiting her father. Elizondo denied the allegations.
