Comments: So my doctor, who is also a surgeon, convinced me to have surgery to correct a slight deformity. Come out that the surgery didn't make a big difference and I could have used a brace instead, now I have to wear the brace anyway. Can I sure my surgeon for a wasted surgery?

You could, I would advise you to seek a medical lawyer that can give you a more accurate answer. Sometimes doctors are just looking for money and they don't care about their patients.
