Constitution - Article 2 - The Presidency

The second article of the US Constitution is in regards to our Presidency. It lays down the laws and procedures that put limits on the presidents power and tell how to take action against the president if needed. This article ensures that no one, not even the president is above justice by the people.

Section 1
Election, Installation, Removal

Section 2
Presidential Power

Section 3
State of the Union, Receive Ambassadors, Laws Faithfully Executed, Commission Officers

Section 4
Impeachment

Section one is where the said electoral college comes into play. Understand that at this time, it was truly an impossible task to count every single vote in the country. Voting for the president was simplified down to allow for only an educated representative from each state (or more than one) would vote on behalf of its state.

Section two limits most of the presidents power to needing approval and advise from senate. That is significant since the approval of the senate is often by passed these days.

Think that the president just likes to talk once a year in his state of the union address? Nope! He is required to give an account of the state of our union in section 3. Something I didn't know for sure!

Section 4 needs to be quoted.

QUOTE

Section 4. The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.


If you remember correctly, we have had one such president convicted of lying under oath and perjury. He was indeed impeached, but was not removed from office. According to section four, impeachment means removal. But the house of representatives impeached Clinton and the senate voted not to have him removed. However, the impeachment still stands.
