Do you remember the case of Andrea Yates, the woman that killed her children because she wanted to protect them from Satan? One side claimed that she was legally insane and the other side (including the police officers on the scene) said she knew exactly what she was doing and that it was wrong. What is your view?

It is so hard to really determine whether she knew what she was doing but I trust the testimony of the police officers who arrived at the scene and they testified that she knew what she did, the fact that she called the police and the fact that she waited for her husband and mother to be out of the house (as she testified) before killing her kids, is prove itself that she knew that what she was going to do was wrong.

She got a new trial now because of a mistake on the side of the prosecution but I feel she may get the same sentence she got before. Life sentence and she is lucky she did not get the death penalty.

Even though she may have been in a state of mind that was not "normal" she killed five innocent children and she cannot get away with it.

I am shocked by the jury's verdict and looking at the picture of Yates, it seems like she was also shocked. She is going to be send to a hospital and who knows released if a judge considers she can live again in society. I am very distressed by the news.

Andrea Yates had a diagnosed and pre-existing medical problem that was directly related to childbirth, which she had been receiving treatment for. Mr. and Mrs. Yates were told that it was dangerous to have more children. However, Mr. Yates (Rusty) ignored these warning primarily due to his strong religious beliefs and the couple had even more children thus again resulting in Ms. Yates" hospitalization for post- partum psychosis after each birth. To further add to the families difficulties Rusty sold the family home and moved them (1 new born- two toddlers and two slightly older boys) into a small fifth wheel type trailer and then invited one of the prophets of his religious order to live with them. Mrs. Yates is again hospitalized and prematurely released by the attending doctors. Mr. Yates moves the family back into a home only to have Ms. Yates take the lives of her children.

Andrea Yates was mentally ill and suffering from post partum psychosis, which is a very serious and dangerous disease if not treated and monitored and that is exactly what happened. A jury finding her not responsible by criminal insanity is supported by all of her hospitalizations and the subsequent warning by physicians not to have any more babies as the hormonal displacement from birthing triggers the mental condition which did not appeared to have abated between the birth of the last two children. To further her difficulties he was stuck in a trailer with five children and some religious lunatic preaching fire and damnation to her while Rusty is happily off at work.

I believe that Ms. Yates attendance to the courts was to say to the rest of the world was I was ill and had no intention of murdering my children. Whatever life Ms. Yates will have, it will be hell on earth and I cannot imagine anything else.

Rusty the stud, filed for divorce from his wife, is happily remarried and wanting to put this all behind him.

The person who should have been on trial for five counts as an accessory to murder and depraved indifference causing death was her husband Rusty Yates. He was an engineer for NASA and was capable of understanding the grave nature of his wife's condition, the ramifications to the quality of life of his children and how to use birth control. He should have gotten the death penalty. That is the crime here!

CharlesR, I must say that throws a whole new perspective on the case - maybe she was insane and severely depressed. What religion was he so diligent in 'keeping' that he was willing to forsake his own family for it? Also, what was the need to live in a trailer? Seems to me with a job at NASA you should be able to afford something good?

Well that is the key there... "he wanted", what about what she and the kids needed?

I do find it odd that it says Andrea embraced the religious fanatic more, that is different to what CharlesR is saying.
