The Mormon student is suing the board for denying him a leave of absence to serve a church mission for two years. The lawsuit was filed Thursday in federal court in Charleston by the American Civil Liberties Union of West Virginia.

"David was faced with a choice between a scholarship and his religious calling,'' said Andrew Schneider, executive director of the West Virginia ACLU. "And his mission was something he'd been saving up to do by mowing lawns since he was eight years old. He chose his religion.''

Schneider said scholarship administrators balked at allowing the religious leave because they said it would be difficult to substantiate the veracity of the leave claim. Currently, leaves of absence from the state's merit scholarship are allowed for military, medical or family reasons, and an "unforeseen leave possibility.'...
