I think if it is illegal to sodomize in a place where you live then one should think doing it is unwise and leave to some where where this is allowed. Should he sent back that is hard since he is facing death for an act that is allowed in the country his fled to.
As for the soldier he should have been sent back for desertion and face death. After all who really needs a traitor in your ranks. If you have qualms about a civilian being hurt in a military operation then you chose the wrong career path as it is bound to happen.
