Chailynn Brown-Hernandez Murder case - Judge gives him another chance because he was "polite" during trial

Man Tortured, Burned And Sexually Assaulted Baby

This case disgusts me for so many reasons. This bastard tortured an 11 months old baby to death! And what happens in the end? Justice is NOT served! Read carefully what his sister said and what the Judge said (All in bold letters).

international QUOTE
A 21-year-old Reading man was sentenced Friday to 15 to 30 years in state prison for killing an 11-month-old girl he was baby-sitting in December 2006.

Rokie A. Torres of the 200 block of Walnut Street was caring for Chailynn Brown-Her nandez in the home of his then-girlfriend, Bethzaida "Betsy" Hernandez-Cruz, while she was in the hospital for surgery.

On Nov. 1, a jury con victed Torres of third-degree murder, aggravated assault and endangering the welfare of a child.

Hernandez-Cruz did not speak during the sentencing hearing in Berks County Court before Judge James M. Bucci and declined comment afterward.

During the hearing, Chailynn's great aunt, Maxine Deck er of Reading, spoke for the family.

"The impact of what was done ... Will stay with our family forever," she said. "Many, many lives were affected.

"We don't know what this world was robbed of and what greatness could have come from her."

Torres did not speak during the sentencing.

His sister, Diana To l entino, asked Bucci to consider that Torres comes from a good family and has values and morals.

Torres" attorney, Jack McMahon of Philadelphia, called Chailynn's death a tremendous tragedy but asked Bucci to consider that Torres has no criminal history.

"You have a terrible crime, but not a terrible person," Mc Ma hon said. "His good background should be of some benefit."

Assistant District Attorney Ellen R. West asked for a sentence of 25 to 50 years because of the brutality of the crime.

"She died of blows to the head, but she had many other injuries," West said. "This was not a quick, painless death. She was 11 months old. She certainly couldn't defend herself."

Bucci said his sentence took into account the brutality of the crime and that the defendant, unlike most young defendants, was respectful and polite during his trial.

"The crime is so terrible and so brutal that it challenges my ability to comprehend human nature," Bucci said. "I find it hard to believe anybody could do the things that happened to this child. This child did not deserve to die in this way.

"I could put him away for life, discard him as human trash. I want to give him an opportunity to have a life after prison."

According to testimony:

On Dec. 20, 2006, the girl was beaten with a hard object in her mother's home in the 100 block of Jefferson Street, causing a fatal head injury and several broken ribs.

She also was burned, possibly by a hot radiator, and sexually assaulted.

Baby Assaulted Sexually Burned Tortured Man

I hope in that 15 - 30 years he gets to be quite friendly with bubba and his buddies. Maybe he will come to understand, after a few beatings, just what that baby went through. I sure hope someone tells bubba this guy is coming to visit him.

I hope he is well played with in his new home. There is no act more vulgar then abusing a child. I hope they split him wide open so he bleeds for the rest of his stay.

As far as his good manners where they great as he beat the baby? Oh is it ok I hit you *no reply* I guess that means yes. Thank you baby.

Maybe he was polite when he beat the baby. "wham" Oh I am sorry I hit you. "WHAM!" Oh I am terrible sorry that I hurt you again. Maybe he needs this type of pay back in prison.

What? This guy is trash that should have been discarded--- Why should he have chance to live his life after imprisonment, he didn't give that poor little baby any chance to life!

This really angers and disgusts me, that again another case has come forward where more priority has been placed on the violator than on the victim!

Regardless of whether he came from a good background or not, he chose to inflict this torture on the baby, and it was seemingly done over a while, and not in the heat of the moment, which in my opinion makes him even more dangerous and calculating!

This just sends a message out to people to do what they want, and if you're polite to the judge- you'll get a lenient sentence- this certainly iss not justice for this baby or the family!

Man Tortured, Burned And Sexually Assaulted Baby

In cases like this, where the character witnesses for the defendant are as shocked about the incident as are the victim and relations always leave me wanting to see the psychology report on the defendant. I often desire that a case like this, especially, that this particular piece of information would be released to the public. IF this boy normally was a moral and well mannered person, why did he "flip" in the presence of the infant? There are so many questions the news article does not answer. Was he high on something? Was he unaccustomed to babies and the child cried all night? Did his profile show that secretly he was a pervert and sociopath? He said nothing at his own sentencing, perhaps on the advise of his lawyer. Of course we expect he would say he did not do it ... but what if "HE" actually didn't do it? That he was somehow influenced into this errant behavior? The article said he was alone with the child for two days, but what if he wasn't alone and he's taking the fall for someone of whom he is afraid?

I have had associations with men in prison and unfortunately this boy is not going to find prison easy. His sentence of 15 to 30 means he will be up for parole in 10 years. Inside a prison there are two kinds of people who usually don't get past indoctrination period without being assaulted by the existing inmate population: child molesters and people who molest religious persons. I recall a case from 1974 where a man in New York City had a habit of raping nuns. He was caught and sent to Ryker's Island BEFORE trial. He didn't live to stand trial.

I feel the injustice of his being allowed to live at all after such a brutal way of taking this baby's life but I am also a little shocked at the vehemence of my colleagues on this board in their hatred of the PERSON of this crime. All major religions tell us to hate the actions but remember that the person is a child of god. There just was not enough information in the article for me to develop an opinion of what actually happened and none at all as to why it happened. There is always a why, even if that why is simply that he is a sadistic psychopath, there is SOME kind of why.

That's what I want to know ... why.

This is not the Religions Board, please leave Religion out of this Topic. Regardless to the "why" I find such crimes irrecoverable in all the sense of the word.

1. The person is a sicko, he will not change from that
2. The child is victimized, he will every day of every minute with the consequences of the act
3. Will you be willing to pay for meals and housing to such a person?
4. If you came home and saw this man in the process of doing this to your child you will most likely kill him, so delayed death does not make a difference.

The results of 1+2+3+4=death to the scum.

He is not a boy, he is man. Second, child molesters tend to be the most friendliest and well-mannered people you can think of because they use this strategy to win trust hence I am never fooled by "Oh he is such a nice guy/woman". It doesn't mean anything to me. Hence, I don't think he "flipped" but showed his truly colors. Whether the article provides enough information or not is kind of irrelevant since the guy was not just arrested by a sentence was passed.

He was condemned to time in prison. It is obvious there was enough evidence for that to happen.

If you truly understand the injustice, what are you shocked about? In the other thread about the man who raped the toddler you said you would use him as a guinea pig for medical research, is it this crime of less importance to you? spock.gif Just curious.

What difference does it make? He abused, tortured and killed an innocent baby. The guy is a bastard, a demon in human form and needs to be put to death for what he did. As a mother, I have no empathy for monsters of his kind.
