Texas Teen Faces Capital Murder Charges
This just breaks my heart! It states she didn't know she was giving birth! Well she knew that she DID and then knowingly killed the baby--14 years old! What do they think they are going to do when the baby comes? If they go as far to bring it in the world there are many people who can't have children and would love to adopt. It truly breaks my heart! I think she should be tried as an adult. Having sex is an adult thing to do--so is pregnancy and being a parent--so why after making these choices should she be treated as a child?

| Texas Teen Faces Capital Murder Charges in Bathroom Death of Her NewbornBAYTOWN, Texas - A 14-year-old girl who secretly gave birth in a school bathroom was charged with capital murder Thursday by police, who said she killed the newborn by choking and flushing him in the toilet. The girl was charged as a juvenile; Baytown police Capt. Roger Clifford said prosecutors will decide whether to certify her as an adult. She cannot be executed if convicted because of her age. The girl gave birth April 2 in a bathroom at Cedar Bayou Junior High. Police said she stuffed toilet paper in the infant's throat and submerged him in a toilet. An autopsy confirmed the baby was alive and cried before his mother tried to flush him, police Lt. Eric Freed said. "We have had enough evidence to determine that this action was done intentionally and knowingly," Clifford said. "That means beyond a reasonable doubt in our mind and in mind of the district attorney's office and in mind of the medical examiner's office, that this was not an accident." The girl's attorney, Gerald Yoakum, said the teen didn't realize she was giving birth. She was 35-36 weeks pregnant. School officials in this city 26 miles east of Houston learned of her pregnancy when another student who was in the restroom while the eighth-grader was in labor went to ask the school nurse for help. The infant boy died just three days after another 14-year-old girl delivered a stillborn fetus in the bathroom of an airplane on her way back to Houston from a middle-school field trip. |

Why can't she be executed because of her age? She didn't seem to take that into consideration for her baby before she executed him. Seems like it would be fairplay.

I believe what she did was wrong. I believe any child having a child is wrong. I think better education of young ladies is needed to try to lessen the number of young ladies having sex. The outcome is usually a baby. Most 13-15 year olds are still trying to come to terms with their own self identity and cannot handle the added pressure of having a child on top of that. I believe many know it is wrong to kill a baby but if they have a baby and noone else is around I think they panic. It is during this time of panic we see the result as a new born being killed.
I am with the state of texas on this that they should not receive the death penalty because of them panicing. A lot of counseling and a long period in jail will be enough to suit me. Besides they will have to face the true judge when they die.
