I see this going rather quickly to the Supreme Court. Here's the thing, if it goes now there a pretty good chance of a four to four tie and the opinion of the lower court stands. If they wait for Judge Gorsuch to be appointed they have a chance of overturning this. The issue being the "Conservative" side has one Justice that sometimes sides with the liberals. The liberals almost never switch. And it's the Democrats who scream about out of the mainstream and it's them who appoint the judges that lean the most to one side.
What Abnninja described is exactly what Trump is hoping for with his own pick making the deciding vote. Were this to stand it means Trump, with a flip of a coin, could decide any country cannot come into the USA and a whole bunch of people get turned upside down for no reason.
