In my perspective if the man acts 'gay' then that's his choice; what I'd see as a problem is if he went out his way to inappropriately harass people with lewd messages and actions - which would be a problem. If that never happened then this clearly was a case of discrimination which is unnecessary for the police sector when sexual orientation is not important.
