The law is too powerful anyway. It essentially puts animals always over people, destroys commerce in any way. So I would argue, what's wrong with taking a second look at an overreaching law. There needs to be balance between Job creation, Property rights and conservation. Imagine if an endangered species took residence on your house, apartment , or land. You essentially lose all ability to make changes to your land or home. The law, though necessary at times, is a freedom killer.

LiveSciencecom Science Bad Called Act Species Endangered Changes

I would tend to agree that the law needs to be looked at again. I think it extends too far in the fact that it places the needs of the animal way over the needs of humans. There needs to be some give and take on things. Like said by Dbackers. If am endangered animal takes resident on your land you are stuck. If your a farmer you just lost part of your income.
