This is a first for me but I am in full support of the owner of the McDonald's franchise. This lawsuit should be strictly between the Shermans and the culprit responsible for posting the pictures on the internet. I am still not convinced that the Shermans carelessness should become the franchise owner's problem. It would be interesting to follow this case and see what happens.

I look at this a bit differently. I am only looking for the crime. The crime was the uploading of the pictures to the internet. Where that took place and who did it is important. Should that have taken place by a employee (on the clock) in McDonalds, then I have no problem suing McDonalds (it will be a McDonalds IP NO that submits the upload). If it was a employee that did it on their free time at home, then I have no problem with McDonalds, but the employee is in some serious trouble in court. I dont see McDonalds being responsible for your belongings. McDonalds is not a place where you go to secure things that are important to you...you go there for a meal. So in that regards, if you were to get food poisoning, then yes, McDonalds is at fault. If you checked your cellphone into a lockbox at the bank and the bank lost your phone, then sue away...they failed in their service. You went to McDonalds with the intention of getting a meal that was to your expectations, have a pleasant exchange in getting the meal and not to be harmed by the meal. By all accounts, the meal was fine.

Food poisoning happens because of unsanitary practices or location. As part of your deal with McDonalds, you expect a clean place, edible food and a nice transaction. In the food poisoning case, either McDonalds practices are at fault or their distributors are at fault. However, McDonalds is responsible for a quality check of the food from the distributors and themselves, so that would have failed.

I am sorry people but I just cannot understand why the owner of McDonalds should be held accountable for the pictures being posted on the internet. In my mind, all adults should exercise caution when carrying around valuable items. If Sherman forgot his cell phone at McDonalds and another customer came along, saw the cell phone and decides to take it, should McDonalds be responsible for this? If the cell phone is inside Sherman's pocket and a thief picks his pocket while he is standing in line, waiting to order his meal, should McDonalds be sued for this? The answer to both questions of course, would be a resounding no.

Where food poisoning is concerned, well that's a different matter altogether. McDonalds goal is to ensure the customer receives a delicious meal without any incident. Once the customer could prove that the food poisoning derived from consuming a meal from McDonalds, well by all means, sue! And yes, McDonalds should be held accountable for this and should compensate the customer accordingly.

I still cannot believe that Shermans are suing McDonalds for their own carelessness. I suspect that the Shermans are suffering from one of the Seven Deadly sins: G R E E D!

I agree this does come down to greed but the question is can the greed be justified in a court. That we shall see.

I see this as theft out right buy an employee. It was an invasion of personal space no different then if it has been a phone number or a 10 000 check lifted from a wallet left on the table. Has any one seen a sign put up that McDonalds is not responsible for any stolen personal property? Just thinking in parking lots you see them every where yet at no time is it spoken that the parking lot is a secured lot. I see no difference in the two. I think it comes down to that.

The law is impartial to fairness as viewed by common sense. Just trying to toss out thought that goes against the idea of common sense. I admit it has pulled some excellent responses.

If you leave your cellphone in your car and it is unlocked, then is it McDonalds fault when your naughty pictures end up on the internet and your phone stolen? Probably not...actually, it isnt. If there is a open sewer lid on the lot, then McDonalds is responsible to replace the lid or put up guarding to ensure you dont fall into the hole. If you are mugged on the lot, McDonalds is responsible to have serveilence equipment, but not responsible for your mugging. They are not required to provide security staff on the premisis. There is a minimum that McDonalds has to do for protection on the property, but they are not guaranteeing nor are responsible your safety on the property 100%.

Scale this place up from a McDonalds to a nicer restaurant and I guess no one should every pick up a tip and assume someone just lost some money and will be returning for it?

I can see the argument that the employee represents McDonalds. However, bad things happen everyday during work by employees and we dont sue their owners. Postal workers shoot other workers...do the families get to sue the US government? My wife left her retainer (braces) on the table at a restaurant and they threw it away (knowing that they did it)...arent they somehow responsible for that? I mean it was her personal property that they threw out and they were $150! I have lost keys at a restaurant...they found them and then lost them...shouldnt they have had to pay for changing the locks and not me! I mean...they failed to secure my keys! If someone used the keys to break into my house, should that restaurant be responsible? No...probably not.

Actually that is the issue here it was stolen the picture was in the camera and taken out and placed into the public eye.

I hope the just fine the people who did it let them do their misdemeanor and let it be at that.

Likely would be the case expect it happened in the USA.
