Imagine to have to go through the death of your own child, a toddler and on top of that being accused of killing him. I am glad that this woman is freed and the apology of the doctor, is NOT enough, he should be sent to prison!

| TORONTO - A mother wrongly convicted of murdering her two-year-old son was freed on bail Thursday after spending 14 years in jail on the testimony of a disgraced pathologist blamed for murder charges that led to at least five baseless convictions. In 20 child autopsies reviewed by outside experts in 2005, pathologist Charles Smith was found to have made major scientific errors in evidence that led to baseless murder charges, including in 13 subsequent criminal convictions, at least five of which have since been thrown out of court. "Today I finally have my day. This is my day. I'm out. I made it," Tammy Marquardt, 37, said outside the Ontario Court of Appeal, struggling to catch her breath through tears of joy. Marquardt was convicted of second-degree murder in the death of her son Kenneth and was handed a life sentence in 1995. She said she found the boy tangled in his bedsheets, but Dr. Smith said he was smothered or strangled. Marquardt's lawyer James Lockyer said Thursday that not only did she not kill her son, but no crime was ever committed. Kenneth had seven documented trips to the hospital for seizures, said Lockyer. Smith's findings have since been rejected by six forensic experts, including one who said the epileptic boy could have died from a seizure.... |

How could the jury or judge have even over looked that fact he has a seizure history? I had a young lady die in my apartment the same way. I spent a long long time in the police station. I am so happy she is out but what a terrible cost she has paid.
