Train Workers Could Have Stopped Rape
I'm watching a case covered on FNC about a brave woman (Maria Besedin) that was leaving a NYC Subway train at 2am when a man grabbed her and proceeded to rape her. Before that the woman did make eye contact with train station of workers and they just pushed a panic button but made no physical attempt to help the woman. The woman later sued the train station workers and LOST because the judge says the train station workers are under no obligation to help the woman, what are your thoughts? As a woman, it is a very disturbing case to read but I will try to analyze it from the point of the law. The two workers did not commit any crime, as much as they were "cold" or simple "cowards" or whatever their reason for NOT directly intervening, they did not break any laws therefore how can they be persecuted? We have seen hundreds of cases of people and journalists filming crimes before and NOT intervening and none of them have never been "charged", therefore these two "men" (if you want to call them that way) as sickening and disgusting their behavior was that night, they haven't broken any laws.

I know it sounds strange but most city workers are told not to get involved but to report and witness, or observe and report. The city usually does not want its workers to get hurt when a crime is being reported. If this was me however I would have tried to assist the lady. I just can not stand around and let something like this happen in front of me.
They were not obligated by law but obligated by morality. However, in these times and given the hour I can see their apprehension. The man could have a gun, you may be thinking about your children at home, etc. Sad thing is the man was mentally ill. What was she doing out at that hour anyway?

Does it really matter what she was doing out at that time of night. |
