Brother Charged In Boy's Death

Do you think they were fighting or it was just an accident? It sounds very suspicious to me the way the kid died as well as the time it took to discover he was dead.

ENDWELL -- A Maine-Endwell sixth-grader is dead and his 22-year-old brother is in jail, accused of killing him.

"It's just a tragic situation," said Broome County Sheriff's Department Detective Lt. Patrick Isenburg. "This young man lost his life at the hands of his brother."

An autopsy, police said, showed Peter W. Munck, 12, died from internal bleeding. Police say Shawn J. Munck, 22, put his foot on the boy's midsection Tuesday and exerted enough pressure to cause internal injuries. Peter went to bed that night, police said, and died a few hours later.

A friend of Shawn Munck's, Joe Menard, 23, was in the house in a different room at the time of the incident. He said he heard the boys just "horsing around."

"They weren't fighting," Menard said. "He (Munck) had a good relationship with his brother."

Carolyn Mitrus, 71, the boys' grandmother and primary caregiver, was not at home at the time. She has been in an undisclosed hospital since last week having open heart surgery. As of last night, she had not been told what happened to her grandchildren, police said. Mitrus, whose legal name is Carolyn Munck, has been the boys' guardian since at least 2000. Both of their parents are in prison.

Menard said he left the house that night unaware that Peter was hurt.

At some point, Shawn Munck went to stay with Menard in his Endicott apartment and stayed with him until Saturday, when police came to arrest him. Menard said Munck gave no indication Peter had died.

"I didn't know anything was going on until just today," Menard said Saturday.

The young boy's body stayed in the bedroom at 228 Hastings Ave. for three days before it was discovered, despite two calls from Maine-Endwell school district officials to Broome County Child Protective Services, according to district Superintendent Joseph Stoner....
