Mp3s A Crime?

Mp3s have become extremely popular in years, more so with the availability of programs (some of which are free) with which to rip (copy) music from audio CDs and convert them into Mp3s (Computer language format). Sales in the music industry has gone down because of this as most with internet access choose to download this music for free rather that go out and buy the CD, but is that wrong?

First of all, there are sites (ligit) that allow you to download music for free. They claim they pay a royalty to be able to allow for this. Others state you can listen, but then have to delete it from off your harddrive after a certain amount of time (yeah, as if they will do that) and then others will just give you samples in another format (like real player, wav file, etc).

What is your view? Yes, this has been discussed before in other threads, but this thread is different for one reason in particular... 'is it legal?' We are not just talking about burning for profit or copying, we are talking about downloading from ligit sources online. Some say it is and others say it isn't.

I believe it all has to do with what copyright info is attached to it. Some MP3s can be free others are just pirated! There are certain categories:

1. Those that have been illegally copied into MP3 format
2. Those that can be downloaded only for demo purposes
3. Those that have an expiry or time limit
4. Those that are freeware or free for download
5. Those that can be purchased

Most of it is illegal of course.

I think downloading from the net is just the next logical step. Record companies should embrace it. People dont always want a whole album by a certain band sometimes they only like or want one song, getting it from the net is a much better solution than going to the store and purchasing a CD you might not like.

Does anyone have information on how the record companies are determining that one has illegal music on their computers? Are they going by the programs installed, or are they tracking downloads made since the rulings were made that downloading music was illegal? From the article it seems that some folks who stopped downloading are still being targeted.

From what I understand, it is a joint affair between them and your ISP. Usually they like to target hubs where the users can easily be tracked via the network. They the trace what and where you download and some time after you get something in the mail for a court hearing. You would basically have to find out just how private your info is at your ISP or if they co-operate with such 'operations'.

So this would mean that songs that were downloaded before the trace was initiated would not be scanned for and easily identified? Only current download activity is watched when the trace is on? Also, are the ISP's allowed to scan one's hard drive possibly and look for songs that may have been illegally downloaded? Scanning hard drives would take more effort, but it seems the ISP's are under a lot of pressure from the record companies to persecute to the fullest, so it would not be out of the realm of possibility. If scanning is being allowed, I would think there would be some privacy issues involved here.

If you have a good firewall I do not see how scanning your harddrive would be possible or even allowed. What you download can be recorded, in fact anything you do can be recorded by your ISP - the ISP is the key.
