In relation to the above answer.
No distinction was made when the pronouncement on hot drinks was made.
It simply stated that hot drinks meant Tea etc.
The oxford english dictionary states.
tea

Number 3 clearly states made from leaves fruit or flowers of other plants.
That would include herbal as they are made from leaves from fruit trees etc
