I heard the police are looking at his actions harder and did another search of the home. While they have not charged him they have said he is a person of interest in the case. I think they want to arrest him but they do not have enough evidence. His defense lawyer stated he is cooperating with the police in all matters.
As you can probably imagine, this is one of the major news topics here in Utah. I am sure that the husband is somehow involved, I just keep wondering what happened. Who, in their right mind, takes a 2-year-old and a 4-year-old out camping, on a whim, at midnight on the coldest night of the season? Obviously he was trying to set up an alibi for something.

Husband of missing West Valley woman has left Utah
WEST VALLEY CITY - Josh Powell has left Utah - at least temporarily. Powell attended a vigil for his missing wife, Susan, at an LDS Church in their hometown of Puyallup, Wash., Sunday evening. The vigil was also attended by Susan Powell's parents, grandparents and siblings. Neighbors said Josh Powell went home to Washington state either Friday or Saturday to escape the media attention and be closer to family. Ref. Source 7

E-mails from Susan Powell told of marriage struggles
Several of her friends, who wished to remain anonymous, confirmed to the Deseret News that they had turned over to police e-mails that she sent them in June and July of 2008, the point when all friends agreed the Powells' marriage was at its worst. One friend confirmed that in one of the e-mails, Susan Powell said she was afraid Josh Powell might kidnap her two boys, divorce her or worse. Ref. Source 4
Susan planned everything in a way as to let everybody know about the problems she was having in her marriage, she kept a notebook and even wrote an informal will so if something happened to her or the boys they would come straight for Josh you know what am I saying? I'm pretty sure folks he would fight extradition 'cause if you see his house you would see his relatives moved all his stuff already and he is quite in Washington. What a creep!
