Maybe I am missing something about US law here? If the judge found that she engaged in "habitual, frequent and continuous use of controlled substances and alcohol, how come he did not remove those kids from her custody? I don't get it. He ordered her to undergo drug testing twice a week and avoid "other non-prescription controlled substances" 12 hours before taking custody of the children.
Maybe someone can explain me what's going on?
It is custom to try and keep the children with the mother until it is proven otherwise unsafe. What he is doing is giving her a last chance shall we say. Plus as I lightly pointed out in a previous post, he is no saint either and the mother isnt the picture of stability. So he is seeing if this scare that she got about potentially losing her children, may actually bring her around to start growing up and join the rest of humanity.

I am not surprised at all. After the Judge ordered her to test for drugs twice a week, I knew she could not make it. I wonder if she did the tests or she just did not bother.

Tonight on the Nancy Grace Show, Nancy Grace, examines what factors could have influenced the judge, to rule Britney Spears' losing custody of her children, Sean Preston and Jayden. Many are speculating that it could be a combination of many things: the secret documents, Britney Spears failure to comply with the judge's orders: to drug test twice a week, meet with drug counsellor, enrolling in parenting classes and refusal to sign the judge's order. Tony Barretto's (Britney's former bodyguard) written statement about witnessing Britney using drugs twice, could also contributed to the judge's decision. Also, her expired driver's license (her license was expired since 2001), as well as her recent hit and run, may have weakened Britney's case even more. However, Nancy Grace raises two interesting questions: why Kevin Federline was not ordered to be drug and alcohol tested, like Britney Spears? If Kevin is awarded custody of the children, does this mean that he will receive an increase in his allowance from Britney?
