Paul Duncsak Murder Case

What are your thoughts about the Paul Duncsak murder case? Paul Duncsak was a pharmaceutical executive but some say he may have been aggressive towards his family. Do you feel Edward Ates committed the murder? Ates said he is too fat to kill. Here is an old report on the case:

Duncsak was shot six times as he walked down a hallway. Lesnevich said the shooter first fired from a staircase leading to the basement. That was followed by several shots fired head-on. In order to do that, Lesnevich said, Ates would have had to run up the stairs. Case Murder Duncsak Paul

Looks like they don't have a lot of evidence either way. Though it is strange he researched gun silencers, that's not normal, but not enough to convict. I could see him committing the crime despite his weight. When a persons mind is set on something like this they are not concerned about how heavy they are breathing. The adrenaline and blood is pumping so fast he would probably not even noticed the strain until the ride home. I would say yes he could have committed the crime, but the almost complete lack of evidence to me means I would not be able to convict him.

This is the most ridiculous excuse I have ever heard. I agree there is mostly circumstantial evidence but again how many people have been convicted in the same way?
