12-year-old settles music swap lawsuit

A day after being sued for illegally sharing music files through the Internet, a 12-year-old girl has settled with the Recording Industry Association of America.

She's the first of 261 defendants to settle their lawsuits with the association.

Brianna LaHara agreed Tuesday to pay $2,000, or about $2 per song she allegedly shared.

"I am sorry for what I have done," LaHara said. "I love music and don't want to hurt the artists I love."

Heather McGough thought it would be nice to listen to music while she was working on her Gateway PC at home in Santa Clarita, Calif. So, a few months ago, when a friend of McGough's 14-year-old cousin told her she could get the Gateway to play songs, McGough told the girl to go ahead.

To top this all off, I wish I could find the email that my sister sent to me.  She's really into the Kazaa downloading, music, and videos.  She had just heard about it on the news the other day and was warning me to be more careful about what I download.  :smile.gif  I was like, yea, but I don't have that software on my puter anymore.  Not since my hard drive crashed I haven't downloaded and re-installed the software and I don't plan on it.  I'm gonna be a good girl now.  ;D

I know its kinda a old subject, but with napster back and running I was curious how people feel about the subject. I personally dont see what the big deal is why they want to charge people for downloading music. I personally download music for artist that i only like a couple songs by them. Or if I want to know some songs on the cd, to see if its a good cd. Cause I refuse to buy a cd with songs on it that i dont know at least 2 songs on, cause how do you know its going to be worth your money?

I was the same way, Xtra.  In fact, I used to download the songs to see if I was going to like the cd.  I find the prices of cds to be expensive depending on where you go to get them.  But I don't know about where you live, but in the malls and even Walmart has this music listening center where you scan the cd bar code and you can hear samples of the songs on the cd.  A sorta try and buy type thing.  If I was still downloading music, I would pay for it, only if the song was gonna be worth it.

Now, I agree it is illegal to download and not pay. It is a copywrite issue and if you want the music you should pay for it. That is the law. Just because everyone does it doesn't mean it is o.k., but the industry will need to follow the same law everyone else does for obtaining evidence -- as they should.

Over the summer I went to a guitar workshop. For a week I was around and learned to play the guitar from true musicians. These are your starving artist musicians, not the rich, can buy everything in the world kind of musicians. Everynight we had to go to the concert hall and different people would play. Some of the people would be students while others were the teachers. Between each performance this guy, David Hamburger, would tell jokes or lecture or something, all about the music industry. One night he started talking about music downloading. "The only people complaining are the business people. The only people who want the money are the people recording, more so than the actual artists." The real musicians, the ones like the people I met, need people to download music off the internet. The only way they make money is by their concert tickets. No one is going to go to the concert of a person they have never heard of or have any idea of the music.

I agree, downloading music for the intent to make money is illegal. If you download music, burn music, and sell the CDs you burnt, I think you should get fined. I also think you should get fined if you have a CD and you burn it and sell it to a friend. Otherwise there is nothing wrong with downloading and listening to music for your own enjoyment.

xtra, it doesn't matter that only the business people are complaining. The law is the law. If you don't like the law you can work to change it, but you can't just choose to ignore it because you don't agree with it. What if everyone did that with every law they didn't like?

Of course, the people complaining are the ones losing money. It doesn't matter how rich they are, they are entitled to be paid for their work. The ones who don't want to give them their money are the ones who want to take what they have created and use it for free. So, why don't I just go into Walmart and say "The Walton family has plenty of money, and I am not sure I will like the songs on this CD, so I am just going to take it without paying for it. Now, if I like it maybe I will come back and pay for it."

Just because you can download on the internet without being caught doesn't make it any less illegal. It is still stealing.

Those of you who thought the previous ruling that said the recording industry couldn't force Internet providers to identify subscribers swapping music online meant you could feel free to continue downloading and swapping with no fear, will probably want to read below:

They are continuing to sue, but now are following the same "discovery" rules required of everyone else
