Will you be sued by the music industry?
Music group won't sue small downloaders

The Recording Industry Association of America says it will not go after small violators when it sues people who illegally share songs on the Internet.

The assurance came in a written response to questions by Minnesota Sen. Norm Coleman, chairman of the Senate Governmental Affairs' Permanent Subcommittee on Investigations. Coleman plans to hold hearings on the RIAA's campaign, which he has labeled "excessive."

"RIAA is in no way targeting 'de minimis' users," wrote Cary Sherman, the group's president, in a letter the subcommittee released Monday. "RIAA is gathering evidence and preparing lawsuits only against individual computer users who are illegally distributing a substantial amount of copyrighted music."

:spock: Well I do not think that because they are not willing to go after the small guy that it is okay to keep downloading  and pirating. They are just trying to stop it, not go into bankruptcy. It would cost more than it is worth to go after everyone. They hope by getting the bigger guys that it will help to curb the smaller ones, but if it could all stop it would all be well.

Ever heard of Kazaa? Gaming Video & Issues Computer

I know that there are people out there that download and burn hundreds of copies and sell them.  I think that they should go after them.  I am just one of those 'little guys'.  I don't download much.  Just a few songs to sample if I want to pay that much for a certain cd.  I don't see paying all that money for a cd, that I only like one song on it.

:spock: Sounds like someone is trying to rationalize so they can feel good about downloading the illegally pirated stuff? wink.gif I guess this topic is closer to home for me because I do produce graphics, sound, text, etc, and I do see people taking a piece here and there and trying to rationalize its use. It is a very big problem in Trinidad.

Nah, not really, some of what I download is from pay sites.  Not all are thru my Kazaa program  ;)  But I do understand what you are saying.  If I was someone in the music industry, I would probably be upset too.

I found this article to be quite ironic.

Makers of Kazaa suing record labels

Turning the tables on record labels, makers of the most popular Internet song-swapping network are suing entertainment companies for copyright infringement.

Sharman Networks Ltd., the company behind the Kazaa file-sharing software, filed a federal lawsuit Monday accusing the entertainment companies of using unauthorized versions of its software in their efforts to root out users. Entertainment companies have offered bogus versions of copyright works and sent online messages to users.

I have a relative who is constantly downloading music and movies that have just been released or have even not been released yet. I worry about the legal issues over file-sharing when it comes to this, so I wanted to find out a bit more. First, this is a good explanation as to what file-sharing is:

This case could have a large impact on how information could be shared via computer. What do you think, should file-sharing be legal or not and what are your legal arguments for or against this?

File sharing is totally illegal. All movies and music have copy right laws attached to them. That being said, I download music and movies all the time. If I like it, I buy it. I know that probably sounds like a lame excuse, but I do buy the movie or cd if I like it. I also still rent DVD's and buy it if I like it. The biggest problem I have with the law suits are their purpose. The music and movie industry will tell you its about losing sales to free downloads. Boloney, cd sales, movie theatre revenues, and DVD sales have increased every year since Napster first started file sharing. Rolling Stone magazine claims that downloading of mp3's have actually help increase music sales especially since the advent of online mp3 purchase! So if movie revenues and cd sales are going up, what is the purpose of the law suits? It obviously isn't about revenue, it is about power. Its rich people like music artists and movie execs suing the little people. The average person who downloads movies and cd's does purchase them to begin with, usually because they cant afford them. So now, the multi-million dollar music artists like Metallica, and multi-billion dollar movie companies like paramount, are suing individuals for downloading their stuff illegally. Are they wrong to download? Yes. Is it necessary to sue a poor schmuck for 100,000 dollars because he downloaded a movie? No! This is as wrong as the downloading, the people who didn't buy it before downloading, will now definitely not buy it. And to add to it, they are alienating their young audiences. I used to love Metallica, and I used to actually buy their tapes. After they started suing the kids who made them million heirs for downloading their mp3's, I am not only not a fan, I don't purchase or listen to their music, and I don't attend their concerts which is where music artist make their money. Point in case, Dave Matthews Band not only promotes downloads of their music, they allow kids to bring recorders to their concerts and tape the performance! Anyone want to guess which band grossed the most in 2001, 2002, and 2003? You guessed it, DMB! Tell me downloading really hurts these musicians? I downloaded Coheed and Cambria, a very little known band. I loved it and have purchased both of their cd's. I would never have purchased an unknown bands cd.
