This is such a horrible case for all the persons involved. It was definitely not an "accident" so I wonder what will happen to the girl? The babysitter who is a big woman should have known better!
QUOTE CHAMBERSBURG, Pa.-- A 10-year-old girl has been charged with third-degree murder in the shaking death of an infant in central Pennsylvania.
Her babysitter was also charged Friday in Franklin County for allegedly failing to seek medical care for 11-month-old Heath Ryder.
The Public Opinion in Chambersburg reports 56-year-old Dottie Bowers was caring for both children last summer. Authorities say the girl, then 9, allegedly shook the baby and threw him into a crib. He died a few days later of traumatic brain injury. Source 3

This is definitely a horrible case. I do find it hard to believe that a then 9 year old girl could possibly have that much malicious intent. I do believe she meant to cause her brother harm to make him quiet, but the intent to kill just doesn't seem plausible to me. That baby sitter is definitely going down for negligent homicide, if not as a potential accessory to 3rd degree murder, though that might be a bit of a stretch.

ANy way you look at this case you will have no winners. I feel sorry for the family but that baby sitter should have taken better care. I would never leave a young child with a baby to care or look after. Makes me sad that this little girl has this over her head.
