The name of Jose Padilla has become popular just as terrorism has since 9/11, but unlike most criminals that are caught and tried in a court of law after being provided with a defense attorney, Jose Padilla has none. the reason for this is because he has the label 'terrorist' attached to his name.

According to one official:
As an enemy combatant - a prisoner of war - Padilla need not be charged with a crime. He could be held until the end of hostilities, a distant and indeterminate point in time that the president has said could be years away. And in the meantime, with no access to a lawyer or protection against self-incrimination, he could become a valuable resource for American intelligence officials. He could be squeezed for every drop of information he might have about al Qaeda.

"If this guy thinks he might be there for 20 years with no recourse, he might just say "Okay, let's talk,"" one administration official told Newsweek.

Well, it seems like the US government must decide once and for all what they are going to do with this guy....he is only ONE of thousands detainees by the US without being charged or have access to a lawyer. He has been allow to have a lawyer after two years.

Federal judge: Charge Padilla or release him

(CNN) -- Calling the case a "law enforcement matter, not a military matter," a federal judge in South Carolina has ruled that the U.S. government cannot continue to hold "enemy combatant" Jose Padilla without charging him with a crime.

The ruling says the government has 45 days to do so or Padilla would be eligible for release. The government vowed to appeal the ruling.

The order from U.S. District Judge Henry Floyd sided with defense attorneys who advanced that argument in a hearing last month in Spartanburg, South Carolina, the jurisdiction where Padilla has been detained for 2 1/2 years as a military prisoner.

The Supreme Court ordered last June that the challenge, which originated in New York, be heard there.

Padilla, a 34-year-old American suspected of plotting with al Qaeda to detonate a radioactive "dirty bomb" and to blow up apartment buildings in the United States, was arrested in May 2002 upon landing on an overseas flight to Chicago...

Jose Padilla is in prison without Trial or Charges for 3 Years and 15 Days. Now what is scary about that is supposed I was the one that stepped off a plane and they just arrested me and put me in prison just because I was suspect - with no charges or trial I would feel setup. So the question is... was Jose setup, if not, then what is the big deal with charging the guy already?

MIAMI - Jose Padilla, once accused of plotting with al-Qaeda to blow up a radioactive "dirty bomb," was sentenced Tuesday to 17 years and four months on terrorism conspiracy charges that don't mention those initial allegations.
